AI Advertising Regulations

Pennsylvania Governor Josh Shapiro signed the Artificial Intelligence Deceptive Advertising Act into law, requiring disclosures on AI-generated ads. The legislation mandates that any advertisement—whether a still image, video, audio, or text—that has been significantly modified or generated by artificial intelligence must include a corresponding label in the same format as the ad itself.

Pennsylvania will require labels on AI-generated ads

Pennsylvania’s AI Deceptive Advertising Act leaves a lot of loopholes.

Pennsylvania is one of the first states to require disclosures on AI content, applying those rules regardless of where an ad was created if it airs within the state.

Loopholes and Ambiguities

The law contains notable ambiguities regarding what constitutes significantly modified content. It features carve-outs for parody, satire, commentary, criticism, and material deemed evidently fictional. Additionally, the statute suggests that disclosures are only required when synthetic content creates a false consumer perception, raising questions about how enforcement decisions will be made.

The office of State Senator Nick Pisciottano, who introduced the bill, did not immediately return a request for comment.
